You indicated you made partial payments that were sent back to you. Then you did not make any payments in the months of Sep, Oct, Nov and Dec of 2010.
If this is the case what payments are you speaking of that you sent and that you think you are current on your mortgage.
When you were unable to make the full payments did you inform the lender that you were going to do this. The lender is under no obligation to accept partial payments, unless agreed upon for a certain period of time. You signed a contract indicating the amount you would pay, any deviation from that would be a breach of the contract.
You might consider looking up the local Legal Aid Society or other legal advocates located in your city. You would have to google legal aid followed by the city in which you reside. These agencies are set up to assist those in need of legal help, but is not in a position to pay for legal help.
If you are in foreclosure then the lender would not accept payments from you except under the legal rules of foreclosure procedures of your state.
If you are in a non judicial foreclosure state you would have been sent a notice stating your property would be placed in foreclosure, followed by a notice that you must bring the mortgage current, the a notice of sale would be issued indicating the date, time and place of the sale.
If you are in a judicial foreclosure state then you would have gotten a notice to appear in court to defend yourself against the foreclosure.
Call your lender, not the company that service your mortgage, speak with a manager, see if they might be of any help for you. Your lender would be listed on any foreclosure notice you might have received.
I hope this has been of some benefit to you, good luck.
“FIGHT ON”
You need to get in touch directly with their legal department, not the bozos they hire to answer the telephones.
Write out a list of each missed month, month by month and show a copy of both front and back of each of those checks, in order, one at a time.
Present this to the courts regarding the foreclosure, as well as copy to their legal team.
The judge may have to straighten this out.
